1) Isabelle Jai Photography and the client hereby acknowledge that the following terms and conditions are incorporated in and make a part of the agreement between the parties. 

2) Package & Product Prices are subject to change. This business is not currently registered for GST. 

3) This agreement is governed by the applicable laws of Victoria, Australia.

4) By accepting these terms and conditions, you acknowledge that you are at least eighteen years of age, or the legal age to form a binding contract within your legal jurisdiction.

5) We will not be responsible for any failure or delay in providing services to you due to any events beyond our reasonable control including but not limited to acts of mother nature (including fire, flood, earthquake, storm, hurricane or other casualty), war, civil commotion, labour disputes, strikes, government regulation or restriction.

6) All care and diligence will be exercised in the performance of the assignment/s and that liability is limited to monies paid only should mechanical failure, theft, accident, or any other mishap occur which prevents the fulfillment of this agreement.

7) Your order of any package of photographic services includes the purchase of  the final edited photographic images. These images will be provided as High Resolution JPEG files. RAW/DNG files will not be released to clients under any circumstances. JPEG images recieved by clients are not to be reeedited or processed under any circumstances.

8) You acknowledge that you are selecting us as the sole and exclusive professional photographer for your event and we retain the right to discontinue services without refund or compensation, should other vendor’s or guest’s actions reduce our ability to perform our services.

9) We will not tolerate any poor behaviour such as agression, abuse or rudeness, prior to, during or after the shoot. We will not engage with any organisations or individuals who share values such as racism and discrimination. 

10) Cancellation Policy: All dates may be transfered however cancellation fees will be applicable. Bookings cancelled two weeks prior to the event will incur a 25% cancellation fee. Bookings cancelled seven days prior to the event will incur a 50% cancellation fee and any bookings cancelled less than a week prior to the event will incur a 75% cancellation fee. All fees must be paid within seven days of cancellation. 

11) Pandemic Policy: Any events/shoots cancelled due to government regulations inrelation to the pandemic will be transferred to a later date at no cost to the client. We understand the uncertainty these times provide for clients and work to ensure that rescheduling is as convenient as possible. 

12) All images are provided to you with a ‘personal use, royalty free, perpetual license’. You may print your photos and make copies of your images. We require that you acknowledge ‘Isabelle Jai Photography’  as the photographer when using images in notices and print and social media (e.g. magazines, newspapers, blogs, websites). 

13) Isabelle Jai Photography owns and retains full Copyright of any and all images taken. Permission is granted by you to use the images as we see fit for media publications, marketing and business promotion. This may include online and print publications. 

14) It is a breach of this Copyright agreement to give any and all images to others including vendors, suppliers, designers, stylists, venues and other businesses. You must refer everyone, back to us for permission to use images for their own benefit. Penalties will apply for this breach of Copyright. 

15) Payment Details: Payment must be recieved within 14 working days from when the invoice is issued. Bank details will be provided on the invoice. Payment by Eftpos is preferred, however other payment details can be discussed if necessary.
